O-1 Extraordinary Ability

The O-1 nonimmigrant visa is the premier pathway for individuals with Extraordinary Ability in science, arts, education, business, or athletics, as well as those with extraordinary achievement in the motion picture or television industry. This category allows globally recognized talent to live and work in the United States for an initial period of up to three years, with unlimited extensions available. 

Is the O-1 the right immigration path for you?

To qualify, you must demonstrate extraordinary ability through sustained national or international acclaim. Eligibility is generally divided into two categories:

O-1A: Science, Education, Business, or Athletics

You must demonstrate that you have reached the very top of your field. This is typically evidenced by:

• Receipt of a major, internationally recognized award (such as a Nobel Prize). 

• OR meeting at least three of the specific regulatory criteria (such as original contributions of major significance or high salary). 

O-1B: The Arts, Motion Picture, or Television Industry

You must demonstrate distinction, defined as a high level of achievement and a degree of skill and recognition substantially above what is ordinarily encountered. This is evidenced by:

• A significant national or international award (such as an Oscar or Grammy). 

• OR meeting at least three of the enumerated criteria (such as lead roles in distinguished productions or major commercial success).
