Understanding the Requirements for an EB-2 National Interest Waiver

Obtaining a U.S. Green Card can be a lengthy process, typically involving an employer sponsor and an extended labor certification procedure. Nonetheless, certain highly skilled professionals might be eligible for a notable exception: the EB-2 National Interest Waiver (NIW).

  • Education

  • Entrepreneurship


2. The Applicant Is Well-Positioned to Advance the Proposed Endeavor


You must demonstrate that you are uniquely capable of executing your plan. USCIS will examine your:

  • Education, skills, and knowledge

  • Record of past success in your field

  • A well-developed plan for advancing your proposed work in the U.S.


3. On Balance, it Would Be Beneficial to the United States to waive the Job Offer and PERM Requirements


This final prong is the heart of the waiver. You must show that the national interest served by your contributions outweighs the standard requirement of protecting U.S. workers through the PERM process. This is often established by proving your unique expertise is urgently needed in the U.S. or that the nature of your work is so significant that it justifies the expedited process.
